Omega Shouldn’t Get to Turn Back Time on the Costco Decision

Andrew Shore, Executive Director of the Owners’ Rights Initiative, released the following statement in response to Omega’s petition for a Writ of Certiorari in the case of Omega SA v. Costco Wholesale Corporation.  “The Supreme Court in Wiley v. Kirtsaeng definitively established the right to resell, lend or give away the things you own as a foundational principle in American copyright law,” Shore stated. “By filing this petition, Omega is attempting to place new limitations on the first sale doctrine.  On behalf of ORI’s members and the tens of millions of consumers who engage in the very practices Omega seeks to ban, I encourage the Supreme Court to reject this petition.”
