Court Dismisses Oracle’s Trafficking Claim against TERiX

Action is Notable Victory for Customers of Third Party Maintenance Providers

Sunnyvale, Calif.—January 23, 2013—TERiX, an independent service provider of outsourced IT services, today announced it achieved a significant victory in the case of Oracle America, Inc. v. TERiX Computer Company, Inc., et al. In a recent court decision, a California Northern District Court judge dismissed Oracle’s claim that TERiX trafficked in access credentials.

“While we need to consider this dismissal within its proper procedural context—it’s a base hit, not a home run—we’re nevertheless pleased with the court’s decision,” says TERiX CEO Bernd Appleby. “TERiX does not traffic in access credentials or Solaris Updates and we do not condone, and in fact condemn, such practices by any independent service organization. We remain committed to the customer’s right to repair and maintain their IT assets in any manner they see fit, and we stand with our customers, other independent service organizations, and the business community at large in defense of this right.”

Organizations are increasingly turning to independent service providers for blanket support of equipment regardless of manufacturer in multi-vendor IT environments. While many believe organizations should have the right to turn to third party service providers to maintain and repair their technology, it is becoming increasingly common for the manufacturers of such technology to coerce customers into accepting non-competitive service of their products at non-competitive rates and then canceling support on older products to control the replacement cycle. This takes away the customer’s control over their own IT infrastructure and forces them to abandon equipment that otherwise could have continued providing value.

“We believe one of the principal reasons this lawsuit was filed is because TERiX provides maintenance services that are technically and qualitatively on par with the OEMs but with added value and flexibility that the OEMs either can’t or won’t provide,” added Appleby.
